Terms of Service

These Terms of Service ("Terms") govern your use of the HelloContractor platform at hellocontractor.com ("Platform"). By creating an account or using the Platform, you agree to these Terms.

1. The Platform

HelloContractor is a contractor directory that connects homeowners with residential contractors. We are not a party to any agreement between homeowners and contractors. We do not employ, endorse, guarantee, or insure any contractor listed on the Platform.

2. Account Types

Contractors: You may create a business profile listing your trades, service areas, credentials, and portfolio. You are responsible for the accuracy of all information on your profile. Misrepresentation of licensing, insurance, or credentials may result in immediate account suspension.

Homeowners: You may search for contractors, save favorites, post projects, send messages, and leave reviews. You are responsible for independently verifying any contractor's credentials before hiring.

Affiliates: You may earn commissions by referring contractors to the Platform, subject to the Affiliate Program terms and Stripe Connect requirements.

3. Subscriptions and Payments

  • Free Plan: Basic listing at no cost. Requires annual renewal to remain active.
  • Pro Plan ($599/year): Enhanced profile with photos, reviews, messaging, analytics, and more. Includes a 14-day free trial. Auto-renews annually unless cancelled.
  • Premium Slots ($1,200/slot): Featured placement for a specific trade and town combination. 12-month term. No discounts, no proration.
  • All payments are processed by Stripe. By making a purchase, you agree to Stripe's Terms of Service.
  • Coupons apply to Pro subscriptions only, never to Premium Slots.
  • Referral credits may be applied toward Pro subscription renewal.

4. Pricing Changes

We reserve the right to modify subscription pricing, Premium Slot pricing, and fee structures at any time. Price changes will not affect active subscription terms or Premium Slot terms already in progress. We will provide at least 30 days' notice of pricing changes via email or notice on the Platform before they take effect on renewal.

5. No Guarantee of Results

Listing your business on HelloContractor does not guarantee leads, inquiries, messages, reviews, or new business of any kind. Search placement is determined by our ranking algorithm and is not guaranteed. We make no representations about the volume of traffic, visibility, or business outcomes you may experience from using the Platform.

6. Cancellation and Refunds

  • You may cancel your Pro subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
  • Premium Slots are non-refundable. The 12-month term runs from the date of purchase regardless of cancellation.
  • Free accounts may be deactivated at any time by unpublishing your profile.
  • We do not offer prorated refunds for partial subscription periods.

7. Reviews

  • Reviews must reflect genuine experiences with the contractor.
  • All reviews require email verification before publication.
  • Reviews are subject to a moderation process. Contractors may respond to reviews publicly.
  • We reserve the right to remove reviews that contain false statements, spam, profanity, threats, or personally identifiable information.
  • Contractors may not offer compensation in exchange for reviews.

8. Messaging

  • In-platform messaging is available to Pro and Elite subscribers.
  • Messages must relate to legitimate construction or home improvement inquiries.
  • Spam, solicitation, harassment, or abusive messages are prohibited and may result in account suspension.

9. Prohibited Conduct

You agree not to:

  • Provide false or misleading information on your profile or in reviews
  • Use the Platform to spam, harass, or defraud other users
  • Scrape, crawl, or programmatically access the Platform without authorization
  • Attempt to circumvent rate limiting, security measures, or access controls
  • Create multiple accounts for the same business or person
  • Manipulate search rankings through fake profiles, reviews, or service areas
  • Use the Platform for any illegal purpose

10. User-Generated Content

You are solely responsible for all content you post on the Platform, including but not limited to profile information, photos, portfolio images, case studies, reviews, messages, and project descriptions. HelloContractor does not review, verify, or endorse user-generated content and shall not be held liable for any claims, damages, or losses arising from content posted by users.

11. Intellectual Property

  • You retain ownership of content you submit (photos, descriptions, reviews).
  • By posting content, you grant HelloContractor a non-exclusive, worldwide, royalty-free, perpetual license to display, reproduce, modify, and distribute that content on the Platform, in search results, in marketing materials, and on social media channels.
  • The HelloContractor name, logo, and design are our trademarks. You may not use them without written permission.

12. Indemnification

You agree to indemnify, defend, and hold harmless HelloContractor, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Content you post or submit on the Platform
  • Your interaction with other users, including any contracts, disputes, or damages between homeowners and contractors
  • Any claim that your content infringes on the intellectual property or rights of a third party

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • ANY CONTRACTOR IS LICENSED, INSURED, QUALIFIED, OR TRUSTWORTHY
  • ANY INFORMATION ON CONTRACTOR PROFILES IS ACCURATE OR CURRENT
  • THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • SEARCH RESULTS WILL BE COMPLETE OR REFLECT ALL AVAILABLE CONTRACTORS
  • USE OF THE PLATFORM WILL RESULT IN ANY LEADS, BUSINESS, OR REVENUE

YOU ARE SOLELY RESPONSIBLE FOR EVALUATING AND SELECTING CONTRACTORS. HELLOCONTRACTOR IS A DIRECTORY SERVICE AND ASSUMES NO RESPONSIBILITY FOR THE QUALITY, SAFETY, LEGALITY, OR OUTCOME OF ANY WORK PERFORMED BY CONTRACTORS LISTED ON THE PLATFORM.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELLOCONTRACTOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES FROM CONTRACTOR PERFORMANCE, PROPERTY DAMAGE, PERSONAL INJURY, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO HELLOCONTRACTOR IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Account Suspension and Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any reason at our sole discretion, with or without notice. Upon termination:

  • Contractor profiles will be removed from search results
  • Outstanding Premium Slot terms will not be refunded
  • Unused subscription time will not be refunded
  • Your data will be retained per our Privacy Policy

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration administered in the State of Idaho under the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action, collective action, or representative proceeding. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.

17. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or a notice on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict of law principles.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
